Welcome to Agnibyte Technologies Solution Pvt Ltd. These Terms & Conditions govern the services provided through our website and any projects undertaken by us, including mobile application development, website development, software development, UI/UX design, maintenance, and related digital services.
By placing an order, making a payment, approving a quotation, or asking us to begin work, you confirm that you have read and agreed to these Terms & Conditions.
1. Project Scope
Every project will be completed according to the scope, features, specifications, timeline, and pricing discussed with the client and/or mentioned in the approved quotation, proposal, invoice, email, WhatsApp conversation, or other written communication.
Any feature, functionality, integration, design change, or service that is not included in the original agreed scope may be treated as additional work and may involve additional charges.
2. Pricing
Prices displayed on our website, including prices shown as “Starting at”, represent the minimum starting price for that particular service.
The final project cost depends on factors such as project complexity, number of features, design requirements, integrations, revisions, platforms, development time, and other project-specific requirements.
A final quotation may be provided after reviewing the client’s complete requirements.
3. Payments
The client must make payments according to the payment schedule agreed upon before or during the project.
We may require an advance payment before beginning any work.
Development, design, deployment, delivery of source files, or other project stages may be paused if an agreed payment becomes overdue.
4. Project Start
A project will be considered started once we begin any project-related activity, including requirement analysis, planning, research, wireframing, UI/UX design, development, coding, configuration, resource allocation, setup, or other work related to the client’s project.
5. Refund & Cancellation Policy
Please review our refund policy carefully before making a payment.
Once work on a project has started, payments made toward that project are non-refundable, to the extent permitted by applicable law.
This is because project payments may immediately be used for development time, design work, planning, resource allocation, software services, infrastructure, and other project-related costs.
If a client decides to cancel a project after work has started, previously paid amounts will generally not be refunded.
If the project has not yet started, the client may contact us to request cancellation. Any eligible refund will be reviewed based on the circumstances of the project and any costs already incurred.
Refunds may also be considered in cases such as duplicate or incorrect payments, where applicable.
Nothing in this policy limits any refund, cancellation, or consumer right that cannot legally be excluded under applicable law.
6. Advance Payments
Advance or booking payments reserve development time and resources for the project.
Once project work has commenced, the advance payment becomes non-refundable, subject to applicable law.
The remaining amount must be paid according to the agreed project milestones or before final delivery, depending on the payment terms provided to the client.
7. Changes & Additional Requirements
The client may request reasonable changes during development.
Changes that significantly modify the approved project scope, design, functionality, workflow, integrations, or technical requirements may result in additional costs and changes to the estimated delivery timeline.
We will inform the client whenever a requested change requires additional charges.
8. Project Timelines
Any delivery date or development timeframe provided is an estimate unless explicitly agreed otherwise in writing.
Project timelines may be affected by client response times, requested modifications, third-party services, API approvals, app store reviews, hosting issues, technical dependencies, or other circumstances outside our reasonable control.
9. Client Responsibilities
The client is responsible for providing accurate project requirements, content, images, logos, business information, login credentials where required, and timely approvals.
Delays caused by missing information, delayed feedback, incomplete requirements, or changes requested by the client may extend the project timeline.
The client must ensure that all content, branding, images, documents, and other materials supplied to us can legally be used for the project.
10. App Store & Third-Party Approvals
Where a project involves Google Play, Apple App Store, payment providers, APIs, hosting companies, domain providers, advertising platforms, or other third-party services, approval and availability are controlled by those third parties.
We cannot guarantee approval, ranking, downloads, revenue, account acceptance, or uninterrupted availability on third-party platforms.
The client remains responsible for complying with the policies and requirements of any third-party platform used for their project.
11. Intellectual Property
Unless otherwise agreed in writing, ownership of the final custom project deliverables will be transferred to the client after all agreed payments have been received.
Third-party libraries, frameworks, fonts, plugins, stock resources, APIs, open-source components, or licensed materials remain subject to their respective licenses and ownership terms.
Any unpaid work remains our property until full payment is received.
12. Portfolio Usage
Unless confidentiality has been specifically agreed in writing, we may display completed project screenshots, designs, project names, or general descriptions in our portfolio or marketing material.
Sensitive client information will not intentionally be published.
13. Maintenance & Support
Post-delivery maintenance, upgrades, content updates, feature additions, server management, operating-system compatibility updates, or changes required because of third-party platforms are not automatically included unless specifically mentioned in the agreed package.
Additional support or maintenance may be chargeable.
14. Limitation of Liability
We aim to provide services professionally and according to the agreed project requirements.
However, to the maximum extent permitted by law, we will not be responsible for indirect losses, lost profits, business interruption, loss caused by third-party services, platform policy changes, account suspension, hosting failure, or circumstances outside our reasonable control.
15. Termination
We may suspend or terminate a project if there is non-payment, abusive conduct, unlawful activity, repeated failure to provide required project information, or a serious breach of these Terms.
Any payment obligations for work already completed will continue to apply.
16. Privacy
Any personal information shared with us will be handled according to our Privacy Policy and applicable privacy requirements.
Clients should not provide unnecessary confidential or sensitive information unless it is required for the project.
17. Changes to These Terms
We may update these Terms & Conditions from time to time.
The updated version will be published on this page together with a revised “Last Updated” date.
